At the start of this retrial on Monday for the murder of his two flatmates in 2003, Ram Puneet Tiwary stood up in court and when asked to enter a plea replied confidently: 'Not guilty.'
Those words began a three-week trial in which a Sydney court will once again try to determine what happened that year on Sept 15, when police were called to the apartment where Tiwary lived and found his flatmates dead.
The men, Mr Tony Tan Poh Chuan, 27, and Mr Tay Chow Lyang, 26, had been bludgeoned to death and Tiwary, then 23, was found shaking with blood on his hands. He was convicted of murder, but a retrial was ordered by the Court of Appeal after it ruled that the trial judge had instructed the jury improperly with regard to how they should view certain pieces of evidence.
On Monday, however, the prosecution in the case said it would show beyond a reasonable doubt that Tiwary murdered Tan and Tay, and that the issue of rental for the apartment he shared with the two students was at the centre of the case.
Crown Prosecutor John Kiely alleged that Tiwary had not been paying his share of the rent of the suburban Barker Street apartment where the men lived, going by notes found in Mr Tay's handwriting. The notes stated outstanding sums owed by Tiwary.
Mr Tay had been in charge of settling the A$2,172.60 (S$2,640) rent each month, before collecting his housemates' share. However, Mr Tan and Mr Tay were due to complete their studies and return to Singapore at the end of the semester, leaving Tiwary in the 'stressful situation' of taking on the rent himself, said Mr Kiely. He added: 'There were no more time-outs.'
Referring to items found on the victims, the prosecutor pointed out that both the dead men's wallets appeared intact and contained cash. 'It would appear that robbery was not a motive in this case,' he said.
When the authorities arrived at the scene, they found Tiwary running towards them. He told them that he had been asleep and that he heard his flatmates screaming. When he later came out of his bedroom, they were lying motionless, covered in blood, he said.
Forensic examinations found Mr Tan's blood and strands of hair on a baseball bat owned by Tiwary. Spots of blood found on Tiwary also came from Mr Tan. Mr Kiely said that although the evidence of the case is largely circumstantial, this did not necessarily mean that it was a weak case. He said: 'Sometimes, circumstantial cases can be more convincing and more powerful.'
The case, scheduled to run for three weeks, resumes this morning, when the 12 jury members will be taken to the scene of the murders to get a clearer idea of the apartment's layout, as well its surrounding areas. Video evidence of Tiwary being interviewed by the police will also be screened in court.

The best consolation we got b4 we close the year is the 48 years jail term for the murderer. Compare the streets,buildings,infrastructure, cars on the street,etc of the capital of these 2 countries and you easily see a world of difference in the living/hygiene standards.
They also have ppl working in almost every industry/job around the world while the darkforce mainly in software and labourers. Stark difference in their adaptability and versatility to different environment.
Look at the all economic powerhouses in Asia; Korea, Japan, Hong Kong, Taiwan, China -- think of what these more advance countries have in common in their population...all are descendents of the yellow dragon..
Now you know why MM Lee and even Malaysia PM wants their people to master the language of the superior yellow force for the 21st century....

Ram Tiwary is a double murderer walking around freely in Singapore . In his trial he always try to pin the murders on the occupants of the white sedan car that Tony Tan was in . But the timeline just doesn't fit . Forensic evidence proves that Tay was murdered latest by 12:00 pm at the rented house. But Tony Tan was still in a lecture at UNSW and would not reach the rented house (riding the white sedan ) until 2:00 pm which means if the occupants in the white sedan were the murderers they would have to have entered the house on Barker street twice , but there was no evidence of force entry into the house . Ram Tiwary is the only person ( he was at the crime scene at the time of both murders )with the motive and the opportunity to kill BOTH Tay and Tan . The occupants of the white sedan only knew Tony and they only arrived at the crime scene at 2:00 pm when forensics showed that Tay was killed at 12:00 pm .
Read the book . Ram basically admits it in a roundabout way . In my opinion , he's the murderer and a fantastic liar . Who wouldn't try anything including bull dust to get out of life in jail? He saw the chance., had the financial backing and the legal advice of his experienced cousin to cheat the system . He spent 9 years trying to wiggle out of it by focusing and not letting too much out of the bag . That was his method and it seems to work a lot in the Australian court system : Don't give away too much , and deny it till you're blue in the face .
The court knew he did it but the technicalities and issues in the previous cases meant he had to be acquitted for the sake of the credibility of the NSW justice system .
My take : there was in-house disputes and the two Chinese sided against him . Tony bought a baseball bat for his protection from Ram as he felt threatened .
Tony was agitated at Uni because he knew his housemate might be in harms way staying at home with Ram as there had been an altercation in recent hours and is focused on the incidents and tensions at home . Ram and the first to be murdered stay at home to discuss and work out the finances and living arrangements . It would be fair to say that Ram was asked to leave the home and look for accommodation elsewhere .
Ram is furious and hits Mr Tay ; he's dead . Maybe not Ram's intention , but his rage has taken over .
He needs an alibi but Tony would be home soon .
He figures Tony has to go too .
I don't believe the white car theory at all and think it wasn't Tony getting into the car , but somebody else .

Where is Tony buried at? I used to call me as Master Tony. He even asked me to move in together. I want to pay respect to him. Only if I knew where he is. RIP.
